F-4 Visa Guide for U.S. Citizens of Korean Descent

The F-4 Overseas Korean visa is designed for foreign nationals who previously held Korean nationality or who are direct descendants of former Korean nationals.

It allows long-term residence and relatively broad employment and business activities in Korea. However, an American citizen is not automatically eligible merely because he or she is ethnically Korean. Nationality status, ancestry documents, criminal records and, for some men, military-service rules must be reviewed first.


1. Who May Qualify?

Typical eligible applicants include:

  • A person born in Korea who later became a naturalized U.S. citizen
  • A U.S.-born child of a former Korean national
  • A grandchild or later direct descendant of a former Korean national
  • A Korean-born adoptee who acquired U.S. citizenship
  • Fourth-generation and later overseas Koreans who can document the complete family line

Since 2019, fourth-generation and later descendants may qualify when their Korean ancestry and direct-line relationship can be established with official records.


2. Korea-Born Naturalized U.S. Citizens

A Korean national who voluntarily obtains U.S. citizenship generally loses Korean nationality on the date U.S. citizenship is acquired.

The person must still file a Report of Loss of Korean Nationality so that the loss is reflected in the Korean family registry. Failure to file the report can create problems with visa applications, Korean passports and the nationality status of children.

The normal process is:

  1. File the loss-of-nationality report.
  2. Obtain a Basic Certificate showing the loss.
  3. Prepare the U.S. Certificate of Naturalization.
  4. Apply for the F-4 visa.

Some consulates may accept the receipt showing that the loss report has been filed while the final registration is still pending.


3. U.S.-Born Korean Americans

Being born in the United States does not necessarily mean that the person has only U.S. citizenship.

A person born on or after June 14, 1998 may have acquired Korean nationality at birth if either parent was a Korean national at the time of birth. For earlier births, the applicable nationality rule may depend primarily on the father’s nationality under the law then in effect.

A person who still possesses Korean nationality cannot receive an F-4 visa because an F-4 is a status for foreign nationals. The person may first need to:

  • Register the birth in Korea
  • Confirm the Korean family registry
  • File a renunciation of Korean nationality
  • Wait until the renunciation is officially accepted

Until Korean nationality is resolved, the person may be required to use a Korean passport rather than apply for a Korean visa.


4. Military-Service Issues for Men

A male dual national by birth generally must file a nationality-renunciation declaration by March 31 of the year in which he turns 18 if he wishes to renounce Korean nationality without first resolving Korean military obligations.

If he misses the deadline, ordinary renunciation may be restricted until the military issue is resolved, although an exceptional-renunciation procedure may be available in qualifying cases.

Korean law may also restrict F-4 status for a man who lost or renounced Korean nationality without completing military service, being assigned to wartime labor service, or receiving an exemption. Where the Ministry of Justice permits, eligibility may begin on January 1 of the year in which he turns 41.

Men between approximately 18 and 40 should obtain an individual nationality and military-status review before relying on general F-4 information.


5. Applicants Using a Parent or Grandparent

A U.S.-born applicant who never held Korean nationality may qualify through a parent, grandparent or earlier direct ancestor who previously held Korean nationality.

The applicant normally needs:

  • The ancestor’s Korean Basic Certificate or archived family register
  • Evidence of the ancestor’s loss of Korean nationality
  • The ancestor’s naturalization documentation
  • The applicant’s U.S. birth certificate
  • Birth, marriage and name-change records connecting each generation

For later-generation applicants, every generation must be connected without a documentary gap.


6. Period of Stay

An F-4 visa issued in the United States is generally:

  • Valid for five years
  • Multiple entry
  • Permits a stay of up to two years per entry
  • Limited to one year when required Korean-language documentation is not submitted

After entering Korea and completing domestic residence registration, the period of stay may be granted or extended for up to three years depending on Korean-language proof, exemptions and participation in the Social Integration Program. There is generally no overall maximum residence period as long as the status continues to be renewed.

Former Korean nationals, persons aged 60 or older, children aged 13 or younger and certain other applicants are exempt from the Korean-language-document requirement.


7. Employment Rights

An F-4 holder is generally not tied to one sponsoring employer and may work, change employers, freelance or operate a business within the permitted activity range.

A separate immigration employment report is generally not required, although labor, tax, licensing, business-registration and social-insurance laws still apply.

F-4 holders may not work in certain simple-labor and restricted service occupations.

Examples of restricted occupations include:

  • Delivery and courier work
  • Building and hotel cleaning
  • Garbage collection
  • Apartment security and certain building-management work
  • Leaflet distribution
  • Simple laundry and ironing
  • Bathhouse attendant work
  • Karaoke or PC-room service
  • Golf caddie work
  • Street vending
  • Certain alcohol-service positions
  • Gambling, adult-entertainment and activities contrary to public morals

In February 2026, Korea opened ten previously restricted occupations, including construction labor, manual packing, manual labeling, gas-station attendants, store organizers, parking guides, vending-machine management and certain loading and unloading work. Exact classification depends on actual duties rather than the job title.


8. FBI Criminal Record Requirement

Most U.S. applicants aged 14 through 59 must submit:

  1. An FBI Identity History Summary issued within six months
  2. A federal apostille issued by the U.S. Department of State

A state background check or state apostille is not accepted as a substitute. Applicants who lived in another country for at least one year during the previous five years may also be required to obtain that country’s criminal record.

The Los Angeles Consulate advises that a new FBI record may be required if the applicant waits more than six months after visa issuance before applying for domestic residence registration in Korea.


9. Domestic Residence Card

A person planning to remain in Korea for more than 90 days normally completes a domestic residence report and applies for a Residence Card for Overseas Koreans.

The card is commonly used for:

  • Employment
  • Banking
  • Mobile-phone service
  • Housing contracts
  • Business registration
  • Health and social insurance
  • Online identity verification

If the person does not complete a domestic residence report, foreigner registration is required within 90 days of entry. A change of domestic address must generally be reported within 14 days.


10. Spouse and Children

A non-Korean spouse or minor child of an F-4 holder does not automatically receive F-4 status.

The family member may qualify for an F-1-9 Visiting and Joining Family visa. An F-1-9 does not provide the same broad employment rights as an F-4, so separate work authorization or another status may be required.


Final Recommendation

The three cases requiring the most careful review are:

  • A U.S.-born person whose parent was still a Korean citizen at the time of birth
  • A male under 41 who lost or renounced Korean nationality without resolving military obligations
  • A later-generation applicant whose family names or birth records do not match across generations

For LA and Orange County residents, nationality matters should be resolved with the Korean Consulate General in Los Angeles before relying on an F-4 application. Final eligibility is determined by the Korean consulate and the Ministry of Justice after reviewing the applicant’s individual nationality, ancestry and military records.

F-4는 과거 대한민국 국적을 가졌거나, 대한민국 국적을 가졌던 사람의 직계비속인 외국 국적 동포가 한국에서 장기체류하며 취업·사업·생활을 할 수 있도록 마련된 재외동포 체류자격입니다.

다만 미국 시민권자라고 해서 자동으로 F-4를 받을 수 있는 것은 아닙니다. 특히 미국에서 태어난 한인의 경우 본인도 모르게 대한민국 국적을 함께 보유한 선천적 복수국적자일 수 있으므로, 비자 신청 전에 반드시 국적관계를 먼저 확인해야 합니다.


Ⅰ. 한글 안내

1. F-4 비자란 무엇인가?

F-4는 다음에 해당하는 외국 국적 동포가 한국에서 장기체류할 수 있도록 하는 비자입니다.

  1. 과거 대한민국 국적을 보유하다가 미국 시민권 등 외국 국적을 취득한 사람
  2. 대한민국 국적을 보유했던 사람의 자녀·손자녀 등 직계비속
  3. 한국계 혈통을 서류로 입증할 수 있는 4세대 이후 재외동포

2019년 제도 개정 이후에는 4세대 이후 동포도 직계혈통을 입증하면 F-4를 신청할 수 있습니다.

F-4는 영주권이나 대한민국 국적은 아닙니다. 그러나 특정 회사의 스폰서에 묶이지 않고, 허용된 범위 안에서 취업하거나 사업을 할 수 있다는 점에서 일반 취업비자보다 자유도가 높습니다.

3. 한국에서 태어나 미국 시민권을 취득한 사람

한국에서 태어나 한국 국적을 보유했던 사람이 자진하여 미국 시민권을 취득하면, 원칙적으로 미국 시민권 취득일에 대한민국 국적을 상실합니다.

그러나 자동으로 국적을 상실했다고 하더라도 가족관계등록부에 이를 반영하기 위해 국적상실신고를 해야 합니다. 신고하지 않으면 한국 행정기록에는 여전히 한국 국민처럼 표시되어 F-4 발급, 자녀의 국적업무, 한국 여권 사용 등에 문제가 생길 수 있습니다.

일반적인 순서

  1. 미국 시민권증서와 한국 가족관계서류를 준비합니다.
  2. 주소지 관할 대한민국 총영사관에서 국적상실신고를 합니다.
  3. 기본증명서에 국적상실 사실이 반영되었는지 확인합니다.
  4. F-4 비자를 신청합니다.

국적상실 처리가 완료되지 않았더라도, 일부 공관에서는 국적상실신고를 접수한 영수증으로 F-4 신청을 허용합니다. 최종 심사 과정에서 추가서류가 요구될 수 있습니다.

이름이 달라진 경우

한국 가족관계등록부에는 김영수로 되어 있지만 미국 여권에는 Young Soo Kim 또는 전혀 다른 미국식 이름으로 되어 있다면 다음과 같은 서류가 필요할 수 있습니다.

4. 미국에서 태어난 한인 2세의 가장 중요한 문제

미국 출생자가 곧바로 외국인인 것은 아닙니다

미국에서 태어났더라도 출생 당시 부모가 한국 국적자였다면 대한민국 국적을 함께 취득했을 수 있습니다.

1998년 6월 14일 이후 출생자는 출생 당시 부모 중 한 명이 한국 국적자였다면 선천적 복수국적자가 될 수 있습니다. 그 이전 출생자는 당시 적용되던 국적법에 따라 주로 아버지의 국적을 중심으로 판단하므로 개별 확인이 필요합니다.

선천적 복수국적자라면

아직 대한민국 국적을 이탈하지 않았다면 법적으로는 외국인만이 아니라 대한민국 국민이기도 합니다.

따라서 다음과 같이 처리됩니다.

  • F-4 비자를 신청할 수 없습니다.
  • 한국 비자 대신 한국 여권을 사용해야 할 수 있습니다.
  • 한국 출생신고가 되어 있지 않아도 국적이 존재할 수 있습니다.
  • 먼저 출생신고와 가족관계등록을 한 뒤 국적이탈 절차를 진행해야 할 수 있습니다.

F-4는 외국인을 위한 체류자격이므로, 한국 국적이 남아 있는 사람에게는 발급되지 않습니다.


5. 미국에서 태어난 남성과 병역 문제

한국계 미국인 남성은 F-4 신청 전에 병역과 국적이탈 문제를 특별히 확인해야 합니다.

선천적 복수국적 남성은 일반적으로 18세가 되는 해의 3월 31일까지 대한민국 국적이탈을 신고해야 병역의무와 연결되지 않고 외국 국적을 선택할 수 있습니다. 기한을 놓쳤다면 병역 문제가 해소될 때까지 일반적인 국적이탈이 제한되거나, 예외적 국적이탈허가 절차를 검토해야 할 수 있습니다.

또한 병역을 마치거나 면제받는 등의 사유 없이 대한민국 국적을 이탈·상실하여 외국인이 된 남성에게는 F-4 부여가 제한될 수 있습니다. 법무부가 허용하는 경우 41세가 되는 해 1월 1일부터 F-4 부여가 가능하며, 병역 이행·전시근로역 편입·병역면제 등을 입증하면 그 이전에도 가능할 수 있습니다.

반드시 개별 확인해야 하는 남성 사례

  • 미국 출생 당시 아버지 또는 어머니가 한국 국적자였던 사람
  • 부모가 미국 영주권자였지만 시민권자는 아니었던 상태에서 출생한 사람
  • 한국 출생 후 18세 이후 미국 시민권을 취득한 사람
  • 2018년 5월 1일 이후 한국 국적을 이탈하거나 상실한 사람
  • 국적이탈신고를 했지만 가족관계등록부에 아직 반영되지 않은 사람
  • 과거 한국 주민등록번호나 한국 여권을 사용한 사람

이러한 사례는 단순히 미국 여권만 보고 판단하면 안 됩니다. 기본증명서, 가족관계증명서, 병적증명서와 부모의 시민권 취득일을 함께 검토해야 합니다.


6. 부모 또는 조부모가 한국 국적자였던 경우

본인은 태어날 때부터 미국 국적만 가지고 있었더라도 부모나 조부모가 과거 한국 국적을 보유했다면 F-4를 신청할 수 있습니다.

부모가 한국 국적자였던 경우

일반적으로 다음 서류가 필요합니다.

  • 부모의 기본증명서 또는 제적등본
  • 부모의 국적상실 기록
  • 부모의 미국 시민권증서
  • 신청인의 미국 출생증명서
  • 부모와 신청인의 관계를 연결하는 가족관계서류
  • 이름이 변경된 경우 이름변경증명서

조부모 또는 증조부모가 한국 국적자였던 경우

세대별 혈연관계를 끊김 없이 연결해야 합니다.

예를 들어 증조부모를 통해 신청한다면 다음 관계가 모두 증명되어야 합니다.

한국 국적 증조부모 → 조부모 → 부모 → 신청인

미국 출생증명서, 혼인증명서, 사망증명서, 한국 제적등본, 이름변경증명서 등에 서로 다른 이름이나 생년월일이 있으면 추가 설명서가 필요할 수 있습니다. 4세대 이후도 신청할 수 있지만, 세대가 멀수록 서류 연결이 핵심입니다.


7. 한국 출생 미국 입양인의 경우

한국에서 태어나 미국으로 입양된 사람은 다음 두 가지 가운데 하나에 해당할 가능성이 큽니다.

  • 과거 한국 국적을 보유했다가 미국 국적을 취득한 사람
  • 입양과 국적취득 과정에서 국적상실신고가 아직 처리되지 않은 사람

다음 서류가 필요할 수 있습니다.

  • 한국 기본증명서 또는 제적등본
  • 입양관계증명서

입양 당시 한국 이름과 현재 미국 이름이 완전히 다르면 동일인임을 연결하는 서류가 특히 중요합니다.


8. F-4 비자의 체류기간

미국에서 발급되는 F-4는 일반적으로 다음과 같은 형태입니다.

  • 비자 유효기간: 5년
  • 입국 횟수: 복수입국
  • 1회 허용 체류기간: 최대 2년
  • 한국어능력 서류를 제출하지 않은 대상자는 1년 이하가 부여될 수 있음

한국에 입국하여 거소신고를 한 뒤에는 체류기간 연장심사를 받게 됩니다. 2026년 제도에서는 한국어능력을 입증하거나 면제 대상인 경우 최대 3년, 사회통합프로그램에 등록·수강하면 2년 이내, 등록하지 않으면 1년 이내로 체류기간이 결정될 수 있습니다. 갱신요건을 계속 충족하면 총 체류기간 상한 없이 연장이 가능합니다.

한국어능력 면제 대상

대표적인 면제 대상은 다음과 같습니다.

  • F-4로 한국에서 일정 기간 이상 체류한 사람
  • 국내 초·중·고교 재학자 등

한국에서 태어나 미국 시민권을 취득한 1세대는 보통 과거 한국 국적 보유자이므로 한국어시험 면제 대상입니다. 미국에서 태어난 2세·3세는 다른 면제사유가 없다면 한국어능력 서류가 필요할 수 있습니다.

인정되는 대표적인 한국어 서류

  • TOPIK 1급 이상
  • 사회통합프로그램 사전평가 21점 이상
  • 사회통합프로그램 1단계 이상 이수
  • 세종학당 초급 1B 이상 수료

2026년 12월 31일까지는 사회통합프로그램 1단계 수준이 적용되고, 2027~2028년에는 2단계, 2029년부터는 3단계 수준으로 상향될 예정입니다.


9. F-4로 할 수 있는 일

F-4는 일반적인 E-7 취업비자와 달리 특정 고용주가 스폰서하지 않아도 됩니다.

허용된 직종이라면 다음이 가능합니다.

  • 프리랜서 활동
  • 개인사업자 등록
  • 법인 설립과 경영
  • 회사 이직
  • 전문직·기술직·사무직·판매직 근무

F-4 소지자는 일반적으로 출입국기관에 별도의 취업신고를 하지 않아도 되지만, 근로계약·세금·사업자등록·면허·사회보험 등 일반 법률은 지켜야 합니다.


10. F-4로 할 수 없는 일

F-4가 모든 직업을 허용하는 것은 아닙니다.

2026년 2월부터 다음 직종은 종전 제한에서 제외되어 F-4 취업이 가능해졌습니다.

사행성 업소, 유흥주점 유흥종사자 등 선량한 풍속이나 사회질서에 반하는 활동도 제한됩니다. 직함이 아니라 실제 수행하는 업무를 기준으로 판단하므로, 예를 들어 허용되는 “주차 안내원”과 제한되는 “주차 관리원”은 업무내용에 따라 다르게 분류될 수 있습니다.


11. F-4 신청에 필요한 주요 서류

12. FBI 범죄경력증명서

미국에서 F-4를 신청하는 만 14세 이상 60세 미만 신청자는 일반적으로 다음 서류를 제출해야 합니다.

  1. FBI Identity History Summary
  2. 미국 국무부가 발급한 Federal Apostille

캘리포니아 주정부 등에서 발급한 범죄기록이나 State Apostille은 인정되지 않습니다. FBI 기록은 일반적으로 비자 신청일 기준 6개월 이내 발급본이어야 합니다. 최근 5년 동안 다른 국가에서 1년 이상 거주했다면 해당 국가의 범죄경력서도 요구될 수 있습니다.

중요한 2026년 LA 총영사관 안내

F-4 비자를 발급받은 날부터 6개월이 지난 후 한국에서 거소등록을 신청하면, 한국 출입국기관에서 새로운 FBI 범죄경력증명서를 다시 요구할 수 있습니다.

따라서 한국 장기체류를 계획한다면 비자 발급 후 너무 오래 기다리지 않고 입국·거소등록을 하는 것이 좋습니다.


13. 한국 입국 후 거소증 발급

한국에서 90일 이상 체류하려면 일반적으로 다음 절차를 밟습니다.

  1. 하이코리아에서 관할 출입국기관 방문예약
  2. 국내 거주지 준비
  3. 외국국적동포 국내거소신고
  4. 지문등록
  5. 외국국적동포 국내거소신고증 발급

국내거소신고를 하지 않는 경우에는 입국일부터 90일 이내에 외국인등록을 해야 합니다. 거소를 이전하면 이전일부터 14일 이내에 새 주소를 신고해야 합니다.

거소증은 한국에서 다음과 같은 생활업무를 처리할 때 중요한 신분증으로 사용됩니다.

  • 은행계좌 개설
  • 휴대전화 개통
  • 장기 임대차계약
  • 건강보험·사회보험
  • 운전면허 관련 업무
  • 취업 및 사업자등록

14. 배우자와 자녀

F-4 소지자의 배우자와 미성년 자녀가 한국계가 아니라면 자동으로 F-4를 받을 수 없습니다.

이 경우 보통 F-1-9 방문동거 비자를 검토합니다. F-1-9는 F-4와 취업권한이 동일하지 않으므로 배우자가 한국에서 일하려면 별도의 취업 가능 체류자격이나 허가가 필요할 수 있습니다.

한국계 배우자나 자녀는 자신의 혈통과 국적관계를 기준으로 각각 F-4를 신청할 수 있습니다.


15. 신청 절차 요약

Step 1. 본인의 한국 국적 여부 확인

기본증명서, 가족관계증명서, 제적등본을 발급받아 현재 한국 국적이 남아 있는지 확인합니다.

Step 2. 국적상실 또는 국적이탈 절차

  • 한국 출생 후 미국 시민권 취득: 국적상실신고
  • 미국 출생 선천적 복수국적자: 국적이탈 여부 확인
  • 병역 대상 남성: 병역과 국적이탈 가능 여부 확인

Step 3. 혈통 연결서류 준비

출생증명서, 혼인증명서, 이름변경서류를 이용해 한국 국적자였던 조상부터 신청인까지 연결합니다.

Step 4. FBI 범죄경력과 연방 아포스티유 준비

처리기간이 길어질 수 있으므로 비교적 일찍 시작하는 것이 좋습니다.
